PRIVACY POLICY OF
SVANTEK MOBILE APPLICATIONS:
"Assistant Pro", "Building Acoustics Assistant",
"Remote Dosimetry", and "Sound Power"

This Personal Data Protection Policy, hereinafter referred to as Policy, is drawn up in order to ensure that your personal data is processed and secured in accordance with the applicable requirements of the law concerning data processing and securing, including the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as GDPR).

Definitions:

1. Data Controller – SVANTEK SP. Z O.O. with its registered office in Warsaw at ul. Strzygłowska 81, entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, 13th Economic Division of the National Court Register, under KRS number 0000192065, NIP (Tax Identification No.): 5270105272, REGON (Statistical no.): 002175672.
2. SVANTEK SP. Z O.O. – SVANTEK SP. Z O.O. with its registered office in Warsaw at ul. Strzygłowska 81, entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, 13th Economic Division of the National Court Register, under KRS number 0000192065, NIP (Tax Identification No.): 5270105272, REGON (Statistical no.): 002175672.
3. Personal Data – all information pertaining to an identified or identifiable natural person.
4. Data processing – any operations performed on Personal Data or on personal data, such as collection, recording, compiling, altering, disclosing, and erasing, whether in traditional form or in IT systems.
5. User – a person using the mobile application: Assistant Pro, Building Acoustics Assistant, Remote Dosimetry, or Sound Power.
6. SvanNET – digital property of Svantek providing online services to SVANTEK Devices via the Internet.
7. Assistant Pro – mobile application of Svantek providing connection to SVANTEK Devices via Bluetooth.
8. Building Acoustics Assistant – mobile application of Svantek providing connection to SVANTEK Devices via Bluetooth.
9. Remote Dosimetry – mobile application of Svantek providing connectivity to SVANTEK Devices via Bluetooth for data reading and configuration.
10. Sound Power – mobile application of Svantek providing connection to SVANTEK Devices via Bluetooth.
11. SVANTEK Device – a device purchased directly from Svantek or a Reseller, equipped with the functionality to connect via Bluetooth to the respective Svantek mobile application.
12. Reseller – an entity distributing Svantek’s products and services and selling them to the User under his name and on his behalf.

DATA COLLECTED

Personal Data

1. Svantek mobile applications: Assistant Pro, Building Acoustics Assistant, and Sound Power do not collect, require, or transfer personal data from the User.
2. Assistant Pro application provides optional access to SvanNET with the use of login credentials (login and password to SvanNET). Login credentials are transferred to SvanNET and they are stored in the Assistant Pro to allow Users to easily log in without entering the login and password each time attempting to log into the Assistant Pro application.
3. Remote Dosimetry application requires personal data for account creation and login. This data is collected to enable app functionality and service provision.

Location Data

1. Assistant Pro application collects location data anonymously to enable Markers and transmits it to the Svantek Device.
2. Assistant Pro application stores the location data in the Marker file per user request in the mobile device memory and does not use it for any other purposes in an automated manner.
3. Svantek mobile applications: Assistant Pro and Building Acoustics Assistant do not collect location data when the app is closed or is not in use.
4. Assistant Pro application allows the User to store the Location Data in a Marker file for measurements in the form of a location marker on a map along with weather data parameters.
5. External access to Marker files (outside the application) is protected by the phone’s operating system as they are stored in the private directory of the application.
6. Remote Dosimetry application automatically collects and sends location data, including GPS coordinates, to SvanNET along with measurement results. This data enhances user experience and is essential for the functionality of certain features within the app.
7. Sound Power application does not collect location data.

Third-party data sharing

1. Svantek mobile applications: Assistant Pro, Building Acoustics Assistant, and Sound Power do not share data with any third parties.
2. Remote Dosimetry share’s location data and measurement results with SvanNET as part of its core functionality. Personal data is not shared with third parties except as required by law or for the app’s core functionality. In cases where data sharing is necessary, users will be informed, and consent will be sought where applicable.

Assistant Pro, Building Acoustics Assistant, Remote Dosimetry, and Sound Power

ACTIVITY

1. Svantek mobile applications: Assistant Pro, Building Acoustics Assistant, Remote Dosimetry, and Sound Power use Bluetooth to establish a connection with the Svantek Devices and transfer the necessary measurement data (settings, results, statuses).
2. Assistant Pro application optionally uses the Internet to connect to SvanNET – upon entering login parameters – to load weather parameters and map details when displaying markers.
3. Remote Dosimetry application uses the Internet for functionalities like sending measurement results and location data to SvanNET.
4. Svantek mobile applications: Assistant Pro, Building Acoustics Assistant, Remote Dosimetry, and Sound Power create and store the system operation log file. The file is stored locally in the application’s private directory – it is temporary – the application allows the User to (explicitly) export and share this file in any desirable way (e.g., by email). The file is not automatically transferred anywhere. The log contains technical parameters of system operation such as software versions, hardware parameters, and Bluetooth communication logs.

General Provisions

1. These Terms and Conditions define the rules for using the SVANTEK mobile applications: Assistant Pro, Building Acoustics Assistant, Remote Dosimetry, and Sound Power.
2. By using any of the above applications, the User confirms that they are familiar with the current version of these Terms and Conditions.
3. These Terms and Conditions, together with applicable legal provisions, define the rights and obligations of the User and the rights, duties, and liability scope of SVANTEK SP. Z O.O. as the provider of these applications.
4. The applications are intended to connect via Bluetooth to SVANTEK Devices for the purposes of configuration, data reading, data downloading, and communication with the SvanNET platform (where applicable).

Using the Svantek mobile applications

1. Use of mobile applications is voluntary and may be subject to additional fees, as defined in the SVANTEK Pricelist.
2. The User can enable “allow support access” mode, granting access to SVANTEK or a Reseller to collect and analyze data from the associated SVANTEK Device.
3. The applications must not be used for illegal purposes, in violation of generally accepted moral norms, or contrary to these Terms and Conditions.
4. The User agrees to report to SVANTEK or the Reseller any irregularities, errors, or detected anomalies during application use, and undertakes not to exploit any such issues for fraudulent purposes.
5. For Remote Dosimetry, a user account is required, and access credentials must be handled securely by the User. SVANTEK does not store login passwords.
6. For Assistant Pro, optional login to SvanNET is supported for extended features (weather, map integration, etc.), but no-account creation is required for basic functionality.
7. For Sound Power, no personal data entry or account creation is required. All collected data is technical and handled locally unless exported by the User.

Liability

1. SVANTEK makes every reasonable effort to ensure the proper functioning of the mobile applications on widely used mobile devices but does not guarantee universal compatibility. Compatibility information is published on the SVANTEK website and in the respective app stores.
2. SVANTEK shall not be held liable for:
   • any direct or indirect losses, damages, or lost profits arising from the use or inability to use the applications,
   • malfunctions caused by failure of the User’s hardware, telecommunication networks, or operating systems,
   • security breaches due to third-party apps or operating system vulnerabilities.
3. The applications do not automatically share sensitive data and store logs only locally on the device, unless explicitly shared by the User.

Copyrights

1. All materials, trademarks, graphics, software components, and design elements in the SVANTEK mobile applications are the intellectual property of SVANTEK SP. Z O.O., unless stated otherwise.
2. It is prohibited to copy, distribute, modify, or use any content from the applications, except for:
   • data acquired from SVANTEK Devices, which may be exported by the User,
   • lawful use within the boundaries of the application’s intended purpose.
3. The names “Assistant Pro”, “Building Acoustics Assistant”, “Remote Dosimetry”, and “Sound Power” are protected by intellectual property rights. Unauthorized use of these names in descriptions, product offerings, or promotional materials without written consent from SVANTEK is prohibited.

Final Provisions

1. SVANTEK reserves the right to modify these Terms and Conditions at any time. Updated Terms and Conditions will be published at www.svantek.com and communicated to Users, if applicable.
2. Continued use of the application after changes have been introduced signifies the User’s acceptance of the updated Terms and Conditions.
3. If the User does not accept the updated Terms and Conditions, they may be denied further access to application functionalities requiring such acceptance.
4. For matters not covered by these Terms and Conditions, relevant provisions of Polish law shall apply.
5. Any disputes arising from the use of SVANTEK mobile applications shall be settled by a competent court having jurisdiction over SVANTEK SP. Z O.O.’s registered office.
